If you are experiencing harassment during a divorce or separation, there are both criminal and civil legal options available. We can guide you through the civil and family law remedies under the Protection from Harassment Act 1997.
While there is no strict definition, harassment generally involves behaviour that causes alarm, distress, or fear. This course of conduct becomes harassment when it occurs on at least two occasions, and the perpetrator knows or ought to know their behaviour is harassing.
Harassment is a deliberate act, and the law assesses whether a reasonable person would consider the behaviour as harassment in similar circumstances.

The court can issue a civil injunction to stop the harassing behaviour. This requires proving, on the balance of probabilities, that the behaviour constitutes harassment. If successful, the court can also establish an exclusion zone around your home or workplace.
Alongside an injunction, you can seek damages for anxiety and any financial losses caused by the harassment. However, you must apply for damages within six years of the harassment occurring or becoming aware of it.
If the other party violates the injunction, the court can issue a warrant for their arrest.

While similar, there are key differences:
Non-Molestation Orders require a specific association or relationship with the harasser (e.g., current or former partner, or family member). Injunctions under the Protection from Harassment Act do not have this requirement.
You can seek financial compensation for damages with a Protection from Harassment Act injunction. This is not possible with a Non-Molestation Order, but you could pursue a separate civil claim for damages.
