
As farms are often handed down through generations, a divorce involving a farm can be more challenging to resolve, particularly if the family home is located where the running of the farm takes place. Alongside the emotional ties and the associated way of life, there can be added complexities for farmers going through divorce proceedings.
Our director, Henry Venables, recently spoke to Farm Diversity Magazine on the topic of how farmers can protect their assets during a divorce. Within the article, Henry discussed the factors considered in reaching a settlement, including whether the farm is a matrimonial or non-matrimonial asset, its value, third-party involvement and income streams.
He also shared guidance on how farmers can reach an agreement outside of court, the importance of having the correct documentation in place and the role of a pre- or post-nuptial agreement as a way to protect future interests ahead of time.
