Financial disputes in divorce – James Maguire features in the New Law Journal

Love is greater than money

Following the news that financial remedy orders are being contested in the family courts at the highest level in 15 years, our managing director, James Maguire, penned an opinion piece for the New Law Journal discussing what could be behind the rise in financial disputes.

In the article, James highlights how economic uncertainty, court delays, reduced legal aid and rising fees are all playing a part in the increase. He also explores how these factors are leading to deeper issues, making the divorce process more difficult and, as such, leaving people stuck in unhappy marriages and with uncertainty about their future.

James emphasises how these challenges are causing some people to cut corners and not take the time or seek the appropriate legal advice to secure a fair financial settlement, which can have repercussions later down the line. He also references the recent Standish v Standish [2025] case and how this could impact financial disputes going forward.
