It has been widely reported that Kim Kardashian and Kanye West are now engaged to be married.  However what is lesser known are the potential legal ramifications, if any, of becoming engaged?

Generally, where couples are not married any financial claims between them will be based on trust principles or in relation to children.  However, a fiancé is able to make an application under the Married Women’s Property Act 1882 within three years of the termination of the engagement.  In reality situations where this is relevant and/or appropriate are limited but that is not to say it should be forgotten.

Of course the more important issue facing this couple is likely to be what would happen upon any future divorce.  As yet it has not been reported whether or not they intend to enter into a pre-marital agreement but in the circumstances it would seem a sensible course of action for them to take.
